NORTH CAROLINA STATUTES OF LIMITATION
Professional Malpractice: Medical malpractice actions must be commenced within three years of the act or omission giving rise to the injury, or within two years of the date of discovery, to a maximum of four years following the date of the act or omission. Medical malpractice actions for objects left inside the body may be commenced within one year of the date of discovery, to a maximum of ten years after the date of the act giving rise to the injury.
Personal Injury: Negligence claims must be filed within three years of the date upon which bodily harm caused by the negligent act is or should have been apparent, whichever occurs first. However, all negligence claims must be commenced within ten years of the act giving rise to the injury, regardless of the date of discovery.
Fraud: 3 years.
Libel / Slander / Defamation: 1 year.
Injury to Personal Property: 3 years.
Product Liability: 6 years from date of purchase.
Contracts: 3 years.
